Proposal

To rezone the subject lands to fulfil a condition of consent application B 17/17 LOB.  The effect of the by-law will be to:

  • rezone the retained lot from an Extractive Industrial with an Exception “(EI-E15)” Zone to a Rural “(RU)” Zone and to:

a)    identify that a portion of the lot is within the influence area of an inactive waste disposal site by applying a Holding provision (‘H’) for that portion until such time as a D4 assessment is completed to the satisfaction of the Township; and

b)    include a provision that requires an impact assessment by a qualified professional to address deer wintering habitat.

 

to amend the Exception “(EI-E15)” Zone for the severed lot to include a provision that requires an impact assessment by a qualified professional to address deer wintering habitat.

Planning Act Requirements

This application has been deemed complete in accordance with the Planning Act. 

 If a person or public body would otherwise have an ability to appeal the decision of the Township to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Lake of Bays before the by-law is passed, the person or public body is not entitled to appeal the decision.

 If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Township before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
