Proposal

The applicant is proposing to amend the permitted uses of the Community Service Commercial “(C2)” Zone in order to permit a dry land marina to allow boat repairs and storage of 160 boats.  The following structures are proposed in order to conduct the business:  a shop of 12.1 m x 18.2 m (40 x 60 ft); an office of 12.1 m x 15.2 m (40 x 50 ft), and two boat storage buildings of 8.2 x 57 m (27 x 187 ft).

Relief is also required for the following:

a)     specify that the front yard will be along Highway 35;

b)     Front Yard Setback:  reduce from a required 19 metres (62.3 ft) to 13.7 m (45 ft) for the proposed boat storage buildings; and

c)     Exterior Side Yard Setback:  reduce from a required 14.5 metres (47.5 ft) to 13.7 m (45 ft) for the proposed shop.

This application has been deemed complete in accordance with the Planning Act. 

 If a person or public body would otherwise have an ability to appeal the decision of the Township to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Lake of Bays before the by-law is passed, the person or public body is not entitled to appeal the decision.

 If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Township before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
