Proposal

To rezone a portion of the shoreline of the subject lands from the Environmental Protection – Type 1 Fish Habitat “(EP1(H))” Zone to Environmental Protection with an Exception “(EP-EXXX)” Zone to permit the following:

  • the demolition of a legal non-complying boathouse and dock and its replacement with a new boathouse and dock with a larger footprint
  • an increase in the maximum length of a boathouse from the shoreline from 15 metres (49.2 ft.) to 19.5 metres (64 ft)
  • an increase in the maximum length of a dock from the shoreline from 20 metres (65.6 ft.) to 24.5 metres (80.4 ft)

Lifting of the holding provision “(H)” is required to permit the proposed construction and is subject to a favourable fish habitat assessment, which was submitted to the Township

This application has been deemed complete in accordance with the Planning Act. 

 If a person or public body would otherwise have an ability to appeal the decision of the Township to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Lake of Bays before the by-law is passed, the person or public body is not entitled to appeal the decision.

 If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Township before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
