Proposal

To rezone the subject lands to fulfil a condition of consent application B 25/18 LOB.

The effect of the by-law will be to:

  • rezone the severed lot from a Rural One “(RU1)” Zone to a Waterfront Residential “(WR)” with an Exception “(WR-E(420))” Zone to:

a)    identify it has frontage on a municipally owned, but not a year-round maintained road;

b)    deem it & the benefitting waterfront lot under Roll No. 040-015-05000 to be one lot for planning purposes, with a merger agreement to be entered into; and

c)    identify the watercourse as coldwater.

  • rezone the retained lot to a Waterfront Residential with an Exception “(WR-E(421))” Zone to:

a)    identify it has frontage on a municipally owned, but not a year-round maintained road;

b)    require a Development Permit prior to development to address Section H.18 of the Official Plan; and

c)    provide for a buffer to address visual impact of any development.

Planning Act Requirements

This application has been deemed complete in accordance with the Planning Act. 

 If a person or public body would otherwise have an ability to appeal the decision of the Township to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Lake of Bays before the by-law is passed, the person or public body is not entitled to appeal the decision.

 If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Township before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
