Administrative Monetary Penalty System (AMPS)

What is AMPS?

The Administrative Monetary Penalty System (AMPS) is a faster and more flexible process for payment, appeal and collection of by-law infractions. AMPS will be fully managed by the Township of Lake of Bays and replaces the judicial appeal process.

The Township of Lake of Bays passed a by-law to implement an Administrative Monetary Penalty System in December 2021 to be effective January 1, 2022 and applies to by-law infractions within the Township of Lake of Bays.

Pay the Penalty Notice within 15 days

  • In person at the Finance/Corporate Services counter - 1012 Dwight Beach Road, Dwight, Ontario, P0A 1H0; or
  • By mailing a cheque to the Township of Lake of Bays - By-law Services - 1012 Dwight Beach Road, Dwight, Ontario, P0A 1H0.

How is a Penalty Notice Issued?

The Township By-law Officer can issue a Penalty Notice by one of the following methods:

  • Affixing it to a motor vehicle;
  • Serving personally to the driver at the time of the violation;
  • Delivering personally to the person as soon as reasonably possible;
  • Sending it by mail to the person's last known address;
  • Sending it by fax to the person's last known fax number; or
  • Sending it by email to the person's last known email address.

 

I just received a Penalty Notice. What are my options?

If you have received a Penalty Notice, you must choose one of the two options below within 15 days from the date the Penalty Notice was issued to avoid late payment fee or other administrative fees.

Option 1: Pay the Penalty Notice within 15 days

  • In person at the Finance/Corporate Services counter - 1012 Dwight Beach Road, Dwight, Ontario, P0A 1H0.
  • By mailing a cheque to the Township of Lake of Bays - By-law Services - 1012 Dwight Beach Road, Dwight, Ontario, P0A 1H0.
  • An e-Transfer option is available. Contact the By-Law Enforcement Officer for more information.

Option 2: Dispute the Penalty Notice within 15 days

  • Request a Screening Review by completing the AMPS Request Form within 15 days or by calling 705-635-2272 ext. 1246.

 

How can I dispute my Penalty Notice?

To dispute your Penalty Notice, you must request a Screening Review with a Screening Officer. You can request a Screening Review by completing one of the following:

Please note:

  • The Township requires 3 business days to process your request for a Screening Review.
  • If you requested a Screening Review appointment online, you will immediately receive a confirmation email. Within 3 business days, you should receive an email to notify you of the time and date of your scheduled screening appointment. If you do not receive your appointment notification, it is your responsibility to follow up on the status of your request by calling 705-635-2272 ext. 1246.
  • If you choose to dispute the outcome of your screening review there is a $100 applicable fee for the appeal hearing.

 

What if I missed the deadline to schedule a Screening Review?

Under extenuating or extreme circumstances (such as death or illness), you may be granted an extension to request a Screening Review appointment. Call 705-635-2272 ext. 1225 for more details.

What if I don't attend my scheduled Screening Review or Hearing Review?

If you do not attend your scheduled appointment, the Penalty Notice will be confirmed to person and will be required to pay a fee for failing to attend the appointment. The fee for failure to appear at a scheduling Screening Review appointment is $100 and $250 for a Hearing Review appointment.

What if I am not satisfied with the Screening Officer's decision?

If the matter is still in dispute following the review by the Screening Officer, you can request a review by a Hearing Officer on or before the payment due date listed on your Screening Decision Notice. Please note that there is a $100 applicable fee to request for an appeal to a Hearing Officer. The fee will be refunded if the Penalty Notice is rescinded.

At the Hearing Review appointment, you can provide evidence to support your claim. The Hearing Officer’s decision is final.

 

Can someone else act on my behalf during a Screening Review or Hearing Review appointment?

Yes.  You can authorize another person to act as your representative during a Screening Review or Hearing Review appointment. Please insert the Authorized Representative Information within the AMPS Request Form.

 

What will happen if I ignore the Penalty Notice?

If you do not choose one of the options listed on your Penalty Notice, the Township assumes you have decided not to dispute the Penalty Notice and you may be required to pay additional administrative fees.   

Additionally, if the Penalty Notice and administrative fees remain unpaid, the fees will be added to the person's tax roll.
